Terms of Service

Please read these terms carefully before using the EyesOnTheBus platform.

1. Acceptance of Terms

By accessing or using the EyesOnTheBus website, driver application, parent portal, or administration dashboard (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately discontinue use of the Service.

2. Description of Service

EyesOnTheBus provides a real-time school bus tracking, routing, and emergency communication platform. The Service comprises three integrated components:

  • An administration web dashboard for school officials to manage bus fleets, routes, student rosters, and notifications.
  • A mobile driver interface for turn-by-turn navigation and live telemetry transmission.
  • A parent interface for viewing real-time bus locations, ETAs, and customized geofence arrival alerts.

3. Registration & Billing Terms

Schools may register for the Service under our 60-day free trial campaign. No credit card is required to begin. Following the trial period, the following billing structures apply:

  • Standard Plan: Billed annually at $15 per bus, per month. This covers unlimited administrator accounts, driver accounts, and parent registrations.
  • Premium Branding Add-on: Flat fee of +$35 per month per school, added on top of the base plan and billed annually. This includes full white-labeling (school logo and brand colors), custom domain routing, home page embed widgets, and a dedicated manager.
  • Payment Management: Subscriptions are managed securely via Stripe. Invoices are generated annually, and payment must be completed within 30 days of invoice generation to maintain service access.

4. Driver Telemetry & BYOD Use

The Service is designed to function using drivers' personal or school-provided mobile phones ("Bring Your Own Device" or "BYOD"). Drivers must grant location permission and enable background tracking strictly for safety telemetry while active on assigned routes. Telemetry is shut down automatically when routes are completed or cancelled. Schools are responsible for securing necessary agreements with their drivers for BYOD mobile phone tracking.

5. Safety Disclaimer & Limitation of Liability

EyesOnTheBus is designed as an operational and convenience tool for school fleets and parents. It is not a replacement for parental supervision or active communication between schools and guardians:

  • ETA Approximations: ETAs are calculated using live traffic and road-aware routing models, but unexpected events (traffic accidents, weather, construction) may cause deviations. Parents should not rely solely on ETAs to ensure children's safety at stops.
  • Emergency SOS Alerts: Our 3-tier emergency SOS alert system (push alerts, SMS, voice escalation) is designed for backup redundancy. However, we do not guarantee delivery if local cellular networks are down or unavailable. In severe emergencies, drivers and admins should always prioritize contacting local emergency services (911) directly.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the state in which the school or school district is registered, without regard to its conflict of law provisions.
